 AGENDA ITEM SUMMARY

Recommendation to Adopt an Ordinance Relative to Waiting Period Requirements for Video Gaming Licenses
1/10/2023
Village Board Meeting

Presenter: Brian A. Townsend, Village Manager
Lead Department:General Government
Executive Summary:

When the Village Board authorized video gaming, a provision was included in the enacting ordinance to require that any establishment be in "good standing" for no less than one year prior to application. The qualifications are:

  • Owe no sums of money to the village
  • Have held a liquor license for consumption on the premises
  • Have been in continuous operation for no less than 12 months
  • Have had no legal violations causing a suspension of its liquor or business license in 12 months
  • Be in compliance with all laws and regulations of the village and state

The purpose of this was twofold - (1) to ensure that establishments were fully compliant with village ordinance and not delinquent on monies due before obtaining a gaming license, and (2) allow existing Schaumburg businesses to have some preference in obtaining a gaming operation.

Since that time, businesses that desire video gaming have been able to obtain it. In addition, the industry has now matured in Schaumburg and the need for the condition pertaining to 12 months of continuous operation is no longer necessary. Therefore, an ordinance has been prepared to eliminate it.

 Recommended Action:
The Village President/Liquor Commissioner recommends that the FLAGG Committee recommend to the Village Board to adopt an Ordinance amending Title 11, Chapter 112, Section 112.03(G)(9) of the Schaumburg Village Code Relative to Waiting Period Requirements for Video Gaming Licenses.
